The Kemmerer City Council met in regular session this 26th day of September, 2011 at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Zem Hopkins, Councilman Brian Burg, Councilman Jim Burnett, Councilman Eric Rudy, Councilman Anthony Tomassi, Councilwoman Kelly Blue and Councilman Robert Reetz.

Motion was made by Councilman Burnett to aprove the agenda of September 26, 2011 as presented; seconded by Councilman Reetz and unanimously approved by Council.

VISITORS’ COMMENTS AND PETITIONS:

 

(1) Brittney Ritter with Lincoln Co. Tobacco Prevention addressed the Council regarding the tobacco free zones resolution.

(2) Stephanie Crank addressed the Council regarding the tobacco pollution and waste in Archie Neil park.

(3) Jessica Berge addressed the Council regarding the tobacco pollution and waste in City parks.

(4) Brianna Hysell addressed the Council regarding smoke free parks.

(5) Destiny Neilson addressed the Council regarding the tobacco free zones resolution.

(6) Katie Neilson addressed the Council regarding the tobacco free zones resolution.

(7) Caitlyn Krell on behalf of Kelly Paige addressed the Council regarding the tobacco free zones resolution.

Motion was made by Councilwoman Blue to approve the items on the consent agenda as presented; seconded by Councilman Berg and unanimously approved by Council. Those items were:

OLD BUSINESS:

NEW BUSINESS:

 

(1) Motion was made by Councilwoman Blue to authorize the Mayor to sign the contract with 3 Leg Torso, LLC scheduled on May 10, 2012 in the cultural arts series; seconded by Councilman Reetz and unanimously approved by Council .

(2) Motion was made by Councilwoman Blue to create tobacco free zones within the City of Kemmerer; seconded by Councilman Reetz.

Motion was made by Councilwoman Blue to amend wording in Resolution No. 2011-658 creating smoke free zones within the City of Kemmerer to omit "Tobacco Free" in the title, omit #3, and change "tobacco products" to "smoking" in #4 and to omit "the use of the tobacco" and replace with "smoking" also in #4; seconded by Councilman Tomassi. The vote was called for, those voting "Aye" Councilwoman Blue, those voting "Nay" Councilman Berg, Councilman Burnett, Mayor Hopkins, Councilman Tomassi, Councilman Rudy and Councilman Reetz, the motion for the amendment was defeated.

Councilwoman Blue withdrew her original motion. Motion was made by Councilman Burnett to pass, approve and adopt Resolution No. 2011-658 creating smoke free/tobacco free zones within the City of Kemmerer as presented; seconded by Councilman Reetz. The vote was called for, those voting "Aye" Councilman Burnett, Mayor Hopkins, Councilman Rudy and Councilman Reetz, those voting "Nay" Councilwoman Blue, Councilman Berg and Councilman Tomassi. Motion carried.

COMMENTS:

 

(1) City Administrator Archibald discussed his resignation.

(2) Members of the Council thanked City Administrator Archibald for his help and work as City Administrator. Councilman Reetz attended a meeting held by the Fossil Basin Promotion Board giving the results of a study that shows the economic impact that Fossil Butte National Monument has on our community. The findings from that study are available at City Hall to review.

(3) Mayor Hopkins thanked City Administrator Archibald for his help and work as City Administrator. There will be a workshop held September 27, 2011 at 6:30 p.m. to discuss the City Administrator vacancy. A request was made by the Peternal family to obtain a painting that was donated to the City and has been housed at the Chamber of Commerce. The painting will be returned to the family. Mayor Hopkins also stated that the Kemmerer High School Golf team won 2nd place in the State 2A tournament held at Fossil Island Golf Course this prior weekend.

There being no further business before council, motion was made by Councilman Burg the meeting be adjourned; seconded by Councilwoman Blue and unanimously approved by Council, at 7:49 p.m.

The Kemmerer City Council is seeking individuals to serve on the Kemmerer Main Street Committee to assist them in revitalization of the downtown area.  In December of 2009 the City of Kemmerer was selected as an "Aspiring Community" by the Wyoming Main Street program.  This committee will focus on the development and implementation four areas that make the Main Street program successful.  Those areas are: Design, Organization, Economic Restructuring and Promotion.

The success of the program is dependent upon the citizens of the community participating in the revitalization of the down town.  You can participate by filling out the application and submitting it to the Kemmerer City Hall.
